Paul released from jail

Rickey Paul is a free man again, at least for now.

The 21-year-old New Iberia man was released from jail Tuesday after the 3rd Circuit Court of Appeals in Lake Charles reinstated his bond. Paul is charged with driving the alleged gunmen to safety shortly after the May robbery and shooting death of Sidney Long Jr. Long was shot at his business, Long’s Gun & Pawn Shop.

In a hearing last month, a 16th Judicial District Court judge revoked Paul’s $10,000 bond, citing his failure to obtain a full-time job as a violation of the bond conditions. Paul was ordered on Jan. 28 back to the Iberia Parish Correctional Center where he was to await his May 4 trial.

But Paul’s defense lawyer, Richard Spears, filed an emergency writ application with the court Feb. 3 appealing Judge Edward Leonard’s ruling. Spears argued full-time employment is not “reasonably related” to assuring Paul’s appearance in court, and the court agreed.

“In this case, a person had paid bond and was sitting in jail,” Spears said in a telephone interview.

Spears did not attend the bond hearing in which Paul was remanded to jail and said he received no prior notification of the proceeding. He added Paul was employed as recently as Jan. 23.

Spears said Paul’s probation officer, Bryan Trahan, spoke in open court of Paul’s failure to find a job, though there is no indication in court documents as to what Trahan said. Trahan declined to comment when approached by a reporter the day of the hearing.

Leonard, who according to the appeals court “erred” in sending Paul back to jail, did not return a phone call Wednesday seeking comment. Assistant District Attorney Bo Duhe declined to comment on the appeals court decision.

Paul is charged with two counts of accessory after the fact to first-degree murder. Prosecutors say Paul picked up his cousin, Akeem Evans, 18, and Easton Francisco, 21, just moments after they reportedly robbed and shot Long, 72, in his gun shop on Center Street.

According to court records, Paul received a cell phone call from Evans after the shooting and then drove the two suspects to the Iberia Village Apartments, where he instructed them to await his return.

Long’s daughter, Melissa, has followed the case closely and said she was outraged initially at the amount of Paul’s bond, which she said seemed disproportionately low.

But her reaction Wednesday to Paul’s release seemed more measured.

“Although my family feels the initial bond was too low, we understand the bond assures appearances,” she said.

“We must accept the 3rd Circuit Court of Appeal’s ruling and trust that justice for my father’s murder will prevail.”

Since his initial arrest May 10, Paul has returned to jail twice.

He was arrested Oct. 13 for failure to appear for a mandatory pre-trial hearing.

Paul faces up to 10 years in prison if convicted.

Evans, who was 17 at the time of the shooting, cannot receive the death penalty but could spend the rest of his life in jail if found guilty.

Prosecutors have not ruled out the death penalty in Francisco’s case.

" Hard to believe the court ruling, seems like there is some under current taking place here. So it is ok for him to continue to be a thug? Not to be part of the community by keeping a job, anybody been to court to watch this kid laugh at assisting his cousin and cousins friend after they committed murder. I have, and agree with the judge who put the stipulation. Just how many free get out of jail cards does this kid have? Seems our judicial system needs major overhauling, compare to New Orleans. "

" As for Mr. Brown, racism will always exist because of people like you. You would have nothing to do if it weren't for racism. Dr. King would be appalled at the hate and dissention you spew on a consistent basis. You should ashamed of mentioning his name. I refuse to call you "Reverend" because you are a disgrace to religion. Have you ever done ANYTHING positive to bridge race relations, or are you just like Jesse Jackson, trying to find a way to make a buck off of anything in the news? "

" Master Sparks....I totally agree with you about the consequences of crime. I do not believe that people who are capable of what those guys did to Mr. Long are capable of being rehabilitated. I don't care what color your skin is, a criminal is a criminal. And ones like those belong 6ft under. "

" To: Melissa, do you believe that blacks should have the right to due process? or do you believe that Ricky Paul have the presumption of innocent until proven guilty. Mr Ricky Paul did not kill your father. However, you and Judge Leonard treats Mr Paul like he is already guilty, i believe that racism are behind the prosecution of Ricky Paul. I also believe that some white Judges are racist. "

To Rev. Raymond Brown: He does not seem to be free, but a slave to his bad behavior. "

" Maybe we can all pray with Rev Brown to go along with our neighbors in Texas and just get rid of the trash and then the low lifes will realize the consequences of their crimes, whether BLACK,WHITE,BROWN,RED,YELLOW or whatever. Trash is trash. Not if, but when enough realize you rape ,murder, abuse and molest children YOU DIE like the scum you are. The crime rate will drop off drastically. You go Texas. "

Melissa, keep up the good work of keeping these people behind bars. I hope they get hard labor plus life with no benefit for parole. "

" I was glad to find out that Mr Rick Paul is a free man again, i am continuing my fight to free Mr Rick Paul, and the Jena 6. We are right now planning a march against racism and police brutality, like i said " white supremacy is the prime characteristic of black oppression." The white supremacist movement are using the police to oppress the black community. We must fight back, and demand Justice. Like Dr. King and Huey P. Newton did in the 50's and 60's, racism must be distroyed "
